CDL Marketing Group, LLC d/b/a Career Now Brands (“Career Now Brands”) provides technology-enabled digital solutions dedicated for the employment and education industries (“Services”). This Privacy Policy (“Privacy Policy”) explains how Career Now Brands, including our affiliates, subsidiaries, and family of brands (collectively “Career Now,” “we”, “our,” or “us”) processes and collects information relating to you and your household, including your personal information.

By accessing or using any of the Career Now Brands family of websites (collectively the “Site”), or otherwise providing us with personal information, you agree to the terms and conditions of this Privacy Policy and any updates we make to it. If you do not agree to the terms and conditions of this Privacy Policy, then please do not provide us with your information.  

Changes and Updates to This Privacy Policy

We reserve the right to revise or update this Privacy Policy at any time, and you should periodically read the Privacy Policy to learn of any revisions or updates. We will notify you of any changes to the Privacy Policy by posting the revised or updated Privacy Policy and its “Effective Date” on the Site.  If we make material changes, we will provide prominent notice such as through a notice or banner or, where feasible, via email). Collection of Your Personal Information

We collect personally identifiable information about you to help you use our Services.  “Personal Information” is information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.

Mobile Messaging Policy

By consenting to Career Now Brands’ SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of us through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information. Promotional messages may include promotions, specials, and other information.

You understand that your consent is not a condition of receiving any services from Career Now Brands. Your participation is completely voluntary.

We do not charge for the service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt out of receiving SMS/text messages at any time. Text the single keyword command STOP to +18773765327 or click the unsubscribe link (where available) in any text message to cancel. You will receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you.

We may change any short code or telephone number we use to operate the service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to opt in with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

 

Information We Automatically Collect About You

Career Now and third-party service providers may automatically collect data about you when you use the Site.  This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics so that we can improve our products and Services.  This information includes the following (collectively, “Usage Data”):

  • Device and Browsing Information. When you visit the Site, we collect IP address, browser type, domain names, access times, date/time stamps, operating system, language, device type, unique ID, Internet service provider, referring and exiting URLs, clickstream data, and similar device and browsing information.
  • Activities and Usage. We also collect activity information related to your use of the Site, such as information about the links clicked, searches, features used, items viewed, time spent within the Site, your interactions with us within the Site, and other activity and usage information.
  • Location Information. We may also collect or derive location information about you, such as through your IP address. If you choose to enable location-based sharing with us through your device settings, we may collect precise location information to provide content that is more relevant to your location and to otherwise improve your interactions with the Site. You may turn off location data sharing through your device settings.

Information We Receive from Third Parties

In some instances, Career Now may receive Personal Information about you from other parties, such as our affiliates, business partners, and service providers.  That information may be obtained online, offline, or through publicly available resources.  We may combine this data with the information you provide, and other data we already have about you.

Some parts of the Services allow you to provide us with personal information relating to other parties (collectively, “Third-Party Data”).  If you use any feature of the Services that allows you to communicate with other parties or to provide information regarding other parties (such as to refer another other party to the Site or to provide us information on a spouse, guarantor, dependent, or authorized user), either by submitting Third-Party Data to the Site or otherwise permitting the Site to automatically access Third-Party Data in your possession, you acknowledge, represent, and agree (a) that you have the authority of the relevant other party for us to access and use the relevant Third-Party Data, and (b) that you have notified these other parties and informed them how their information is collected and used by us to provide the Services.  We reserve the right to identify you as the person who has made the referral in any messages that are sent to other parties. We use Third-Party Data to (a) contact such party using the Third-Party Data provided, and/or (b) provide you with an editable template message designed to facilitate communication between you and such party through the Services. We may also send reminders or related messages to you and to other parties on your behalf from time to time, as and where permitted by applicable law.

Artificial Intelligence Chatbot

We use an artificial intelligence chatbot to assist with customer interactions, respond to inquiries, and offer personalized recommendations. The chatbot may use Personal Information such as your communications with us, purchase history, preferences, or Usage Data to help tailor responses or suggest products and services that may be of interest to you.

Cookies & Similar Technologies

Cookies are text files that are sent by servers to web browsers and stored on your computer. They tell us which parts of the Site you’ve visited so we can save your preferences for future visits. Web beacons and pixel tags are images embedded in a webpage or e-mail for the purpose of measuring and analyzing usage and activity. The Site, or third-party providers acting on our behalf, may use web beacons and pixel tags to help us analyze usage and improve our functionality. Some cookies and other technologies may serve to recall Personal Information previously provided by a visitor.

We use the term “Business Partners” to refer to our Third-Party Advertisers, Marketing Partners, and Analytics Providers, as detailed below:


Third Party Analytics Providers & Marketing Partners.  We use third party tools, which are operated by third party companies, to analyze ad traffic and usage of the Site. These tools collect data about your interaction with the Site via the cookies and through the standard implementation. This data may be used for purposes including delivering banner advertisements and other advertising tailored to your interests when you visit certain websites. These include, but are not limited to:

Cross-Device Tracking. We and our providers may use the information we collect about you within the Site and on other third-party websites and services to help us and these third parties identify other devices that you use (e.g., a mobile phone, tablet, other computer, etc.) to interact or engage with us or the Site.

Third-Party Advertising Partners. We work with third-party ad networks, analytics, marketing partners, and others (“third-party ad companies”) to personalize content and display advertising within the Site, as well as to manage our advertising on third-party sites. We and these third-party ad companies may use cookies and other tools to collect browsing and activity information within the Site (as well as on third-party sites and services), as well as IP addresses, unique IDs, cookie and advertising IDs, and other online identifiers. We and these third-party ad companies use this information to provide you more relevant ads and content within the Site and on third-party sites, and to evaluate the success of such ads and content. ·       Google AdWords.  The Website uses the Google AdWords remarketing service to advertise on third party websites (including Google) to previous visitors to the Site. That could mean that we advertise to previous visitors who haven’t completed a task on our site. This could be in the form of an advertisement on the Google search results page or a site in the Google Display Network. Third-party vendors, including Google, use cookies to serve ads based on someone’s past visits to our sites. Any data we collect will be used in accordance with this Privacy Notice, and Google is responsible to abide by its own Privacy Notice.

·       Social Media & Search Pixels.  We use Meta Pixel, LinkedIn pixel, and other social media and search pixels to better measure, optimize, and retarget our marketing campaigns. This allows user-specific behavior to be tracked after the user has been redirected to the advertiser’s website by clicking on a social media or search ad. This enables us to measure the effectiveness of social media and search ads for statistical and market research purposes. The data collected in this way is anonymous to us, in other words, we do not see the personal information of individual users. This data is stored and processed by the social media and search providers. While we may use a variety of service providers to perform advertising services, some of these companies are members of NAI or the Digital Advertising Alliance (“DAA”) Self-Regulatory Program for Online Behavioral Advertising. You may want to visit http://www.networkadvertising.org/managing/opt_out.asp, which provides information regarding targeted advertising and the “opt-out” procedures of NAI members. Do Not Track. Currently, the Site does not recognize all “Do-Not-Track” requests. You may, however, disable certain tracking by disabling cookies. How We Use Your Information

We collect and use information for business and commercial purposes in accordance with the practices described in this Privacy Policy. Our business purposes for collecting and using information include:

·       Targeted Advertising. ·       To Create and Use Identifiers. We may generate hashed identifiers (e.g., from your email address) or first-party identifiers to recognize users across devices, measure ad effectiveness, and enable personalized advertising. These identifiers may be shared with Business Partners and Service Providers in connection with our advertising efforts, subject to applicable laws. 

·       Research, Development, and Surveys. To administer surveys and questionnaires, such as for market research or user satisfaction purposes and to develop new products and services, including market analysis and product testing.

·       User-Generated Content. To enable you to post and share content, such as reviews, comments, forum posts, and other submissions, and to publish this content within the Career Now Brands community.

To protect the Services and our business operations, and to protect our rights or those of our stakeholders; to prevent and detect fraud, unauthorized activities and access, and other misuse; where we believe necessary to investigate, prevent or act regarding illegal activities, suspected fraud, situations involving potential threats to the safety or legal rights of any person or third party, or violations of our terms and conditions.

·       Compliance and Legal Process. To comply with applicable legal or regulatory obligations, including as part of a judicial proceeding; to respond to a subpoena, warrant, court order, or other legal process; or as part of an investigation or request, whether formal or informal, from law enforcement or a governmental authority.

·       Auditing, Reporting, and Other Internal Operations. To conduct financial, tax, and accounting audits; audits and assessments of our operations, privacy, security and financial controls, risk, and compliance with legal obligations; our general business, accounting, record keeping and legal functions, and to maintain appropriate business records and enforce company policies and procedures.

·       General Business and Operational Support. To assess and implement mergers, acquisitions, reorganizations, bankruptcies, and other business transactions such as financing, and to administer our business, accounting, auditing, compliance, recordkeeping, and legal functions.



How We Disclose Your Information

We share some information with service providers and partners who assist us in operating our Site and Services and, in some cases, legal authorities.

  • With our service providers (“Service Providers”).
    • We use third parties and vendors to help us operate and improve our Site and Services. These third parties assist us with various tasks for business purposes, including website support and analytics. We do not allow these parties to use your information for any purpose other than to perform those services.
  • With our Business Partners, or Third Party Advertising Partners and Third Party Analytics Providers & Marketing Partners.   • With your Authorized Representative.  If another individual is managing your account or access to the Services on your behalf, as authorized by you or as a personal representative under applicable law, that person can view all Personal Information about you in the Services.

    • We may share and disclose Personal Information to employers and educational institutions in accordance with your instructions, including any applicable terms in our Terms of Use and in compliance with applicable law and legal process.

Any data collected by third parties is not covered by this Privacy Policy. Confidentiality & Security

Career Now values your privacy and is committed to protecting your information.  We have commercially reasonable administrative, technical, and physical safeguards in place commensurate with the size, scope, and nature of our business to ensure the integrity and security of your information.

Information Retention

We keep your personal data only as long as necessary to provide you with our services and for legitimate and essential business purposes, such as maintaining the performance of our Site and Services, making data-driven business decisions about new features and offerings, complying with our legal obligations, and resolving disputes.

Children

We do not knowingly collect or solicit personal information from children under the age of 16. If you are under 16, please do not provide use our Site. By providing information via the Site, you represent that you are at least 16 years old. If we learn we have inadvertently received or collected Personal Information from a child who is under the age of 16, we will attempt to immediately delete that information from our files and records.  If you believe a child who is under the age of 16 has provided us with Personal Information, please contact us at the address listed below in “Contact Us.”

International Visitors

The Site is intended solely for residents of the United States and we do not do business outside the U.S. If you provide Personal Information to us, please note that it will be transferred, processed, collected, used, accessed and/or stored in the United States and subject to U.S. laws. Identity Verification and Appeal Process

If you request to access, correct, or delete your Personal Information under State Privacy Laws we are required by law to verify your identity before processing your request. When you make such a request, you can expect the following:

  • We will verify your request. You will need to provide us with your email address and full name.  We may ask for additional information if needed.
  • We will confirm that you want your information accessed, corrected, and/or deleted.
  • We will confirm our receipt of your request within 10 days. If you have not received a response within a few days after that, please let us know by contacting us at the webpage or phone number listed below.
  • We will respond to your request within 45 days upon receipt of your request. If necessary, we may need an additional period of time, up to another 45 days, but we will reply either way within the first 45-day period and, if we need an extension, we will explain why.
  • In certain cases, a request for access, correction, or deletion may be denied. For example, if we cannot verify your request, the law requires that we maintain the information, or if we need the information for internal purposes such as providing Services or completing an order. If we deny your request, we will explain why we denied it and delete any other information that is not protected and subject to denial.
